Welcome to Fabdale.

These Terms & Conditions (“Terms”) govern your use of Fabdale.com and purchases made through the website.

By placing an order after having the opportunity to review these Terms, you agree to the version of the Terms applicable at the time of your order.

These Terms should be read together with Fabdale's Privacy Policy, Delivery Policy, Cancellation Policy, Return, Exchange & Refund Policy, where applicable.

Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded under the laws of Nepal.

1. About Fabdale

Fabdale.com is operated by Fabdale Lifestyle Pvt. Ltd. , as a list-based e-commerce business in Nepal.

Unless expressly stated otherwise, products offered through Fabdale.com are sold directly by Fabdale.


2. Eligibility & Customer Information

You should place an order only if you are legally capable of entering into the transaction or are acting with appropriate parental, guardian or other lawful authorization where required.

Customers must provide accurate information reasonably necessary to process an order.

Fabdale may refuse a transaction where completing it would violate applicable law.

3. Product Information

Fabdale aims to provide clear and accurate product information before purchase.

Depending on the product, this may include:

  • product name and description;
  • images;
  • material or fabric;
  • colour and design;
  • size or dimensions;
  • quantity;
  • country of origin;
  • producer/manufacturer or importer information where applicable;
  • price;
  • warranty information; and
  • other material information required for an informed purchase.

Customers should review the selected product, size, colour, variant and quantity before confirming an order.

4. Images, Colours & Measurements

Fabdale makes reasonable efforts to display products accurately.

Minor colour differences may occur because of photography, lighting or differences between device displays.

Measurements may also contain reasonable manufacturing or manual-measurement variations where appropriate to the nature of the product.

These allowances do not permit a material misrepresentation of the product.

5. Prices, Taxes & Discounts

Prices on Fabdale.com are stated in Nepalese Rupees (NPR) unless otherwise indicated.

Before order confirmation, customers will be able to review the applicable price and compulsory charges.

Where Fabdale displays an MRP, previous price, discount or promotional saving, the representation will have a genuine and supportable basis.

Promotional prices may be limited by time, stock or disclosed campaign conditions.

6. Placing an Order

Before confirming an order, customers should review the material transaction details shown at checkout.

An order is submitted when the customer completes checkout and selects Place Order, Confirm Order, or an equivalent action.

Fabdale will provide an electronic order confirmation containing or providing access to the material order information.

7. Electronic Contract & Order Records

A transaction completed through Fabdale.com may constitute an electronic contract under applicable Nepal law.

The applicable contract includes the order information presented to the customer together with the version of these Terms and relevant policies applicable at the time of purchase.

Fabdale may retain appropriate transaction records for legal, accounting, customer-service and dispute-resolution purposes.

8. Order Verification

Fabdale may contact a customer where reasonably necessary to verify:

  • customer or delivery information;
  • product selection;
  • payment status;
  • suspicious transaction activity; or
  • another matter necessary to complete the order.

Verification will not be used unfairly to delay or deny a legitimate transaction.

9. Product Availability

Product availability may change because inventory is limited.

If Fabdale is genuinely unable to supply a confirmed product, the customer will be informed and provided with an appropriate remedy.

Where payment has already been received for an order that cannot be fulfilled, the amount lawfully due will be refunded within the applicable period.

Fabdale will not require a customer to accept a substitute product without agreement.

10. Technical or Pricing Errors

Fabdale takes reasonable care to maintain accurate product information and pricing.

Where a genuine and obvious material technical, typographical or pricing error occurs, Fabdale may contact the customer before fulfilment and offer an appropriate lawful resolution.

This may include proceeding on corrected terms with the customer's agreement or cancelling the affected transaction and refunding any amount lawfully due.

This provision will not be used merely because Fabdale later considers an agreed price commercially unfavorable.

11. Payment

Available payment methods will be displayed during checkout.

Fabdale may offer:

  • Cash on Delivery;
  • authorized digital payment services; and
  • other legally permitted payment methods.

Electronic payments remain subject to successful confirmation through the relevant payment provider.

Customers must not knowingly use false, fraudulent or unauthorized payment information.

12. Invoice & Transaction Record

Fabdale will provide an invoice, receipt or other transaction record as required by applicable Nepal law.

The applicable invoice will identify the legal seller and contain legally required transaction and tax information.

Customers should retain their electronic order or invoice record for future reference.

13. Delivery

Delivery availability, applicable charges, estimated delivery information and other delivery conditions are governed by Fabdale's Delivery Policy.

Please review the Delivery Policy before placing an order.

14. Open. Check & Accept

Where available, Fabdale's Open. Check & Accept service allows customers to inspect eligible products at delivery according to the conditions stated in our Delivery Policy.

The service is intended for reasonable product inspection and does not automatically permit clothing to be worn as a fitting trial.

Using or completing Open. Check & Accept does not remove any non-waivable consumer right available under Nepal law.

15. Cancellation

Order cancellation is governed by Fabdale's separate Cancellation Policy.

Cancellation availability may depend on the order stage, including whether the order has already been processed or dispatched.

Nothing in the Cancellation Policy or these Terms removes a cancellation right provided by applicable Nepal law.

16. Returns, Exchanges & Refunds

Returns, exchanges and refunds are governed by Fabdale's Return, Exchange & Refund Policy and applicable Nepal law.

A product-level return restriction will not override a statutory remedy where a product is materially misdescribed, defective, wrongly supplied or otherwise legally required to be remedied.

Where a refund becomes legally due, Fabdale will process the applicable amount within the required period.

17. Warranty & Guarantee

Where a product carries a commercial warranty or guarantee, the relevant provider, duration and material conditions will be disclosed with the product or applicable warranty information.

Where no additional commercial warranty exists, Fabdale may state:

“No additional commercial warranty.”

The absence of an additional commercial warranty does not remove statutory rights relating to defective, misdescribed or otherwise non-conforming products.

18. Customer Responsibilities

Customers are responsible for:

  • providing accurate contact and order information;
  • selecting the intended product, size, colour and variant;
  • reviewing the order before confirmation;
  • paying the applicable amount;
  • providing a usable delivery address;
  • reasonably cooperating with delivery;
  • raising genuine complaints or claims; and
  • providing reasonable information necessary to investigate a claim.

Customers must use Fabdale's ordering, delivery, return, refund and grievance systems honestly.

19. Fraud, Abuse & Unauthorized Activity

Fabdale may take reasonable measures to prevent or investigate suspected:

  • fake or fraudulent orders;
  • payment fraud;
  • identity misuse;
  • false refund or return claims;
  • product substitution;
  • fabricated delivery claims;
  • unauthorized account activity; or
  • intentional abuse of promotions or services.

Where there is reasonable evidence of serious fraud or misuse, Fabdale may restrict an account or transaction subject to applicable law.

A customer will not be penalized merely for legitimately exercising a consumer right.

20. Customer Accounts

Customers are responsible for maintaining the confidentiality of their account credentials and should notify Fabdale if they suspect unauthorized access.

Fabdale may require reasonable identity verification before disclosing confidential account information or making sensitive account changes.

Account information, correction and account deactivation are governed in detail by Fabdale's Privacy Policy.

21. Privacy

Fabdale processes customer personal information according to its Privacy Policy and applicable Nepal law.

Information reasonably necessary to fulfil an order may be shared with authorized service providers such as payment and delivery partners.

22. Reviews & Customer Content

Fabdale may allow eligible customers to submit genuine product reviews, ratings, photographs or feedback.

Fabdale will not knowingly create or publish fictitious consumer reviews.

Reviews may be moderated for legitimate reasons such as:

  • spam;
  • abusive or unlawful content;
  • advertising;
  • irrelevant material;
  • private personal information; or
  • fraudulent content.

A genuine review will not be removed solely because it expresses a negative opinion.

Customers must not submit content that infringes another person's rights or contains deliberately false or unlawful material.

23. Intellectual Property & Website Use

The Fabdale name, logo, original website content, photographs, graphics and other original material may be protected by applicable intellectual-property law.

Customers may use Fabdale.com for lawful personal shopping and related purposes.

Users must not intentionally:

  • gain unauthorized access to Fabdale systems;
  • interfere with website security;
  • introduce malicious software;
  • impersonate another person;
  • submit fraudulent information;
  • unlawfully copy or commercially exploit protected Fabdale content; or
  • otherwise use the website for unlawful purposes.

Fabdale may take reasonable measures to protect its website, customers and business against unlawful misuse.

24. Liability, Third Parties & Events Beyond Control

Fabdale may use suppliers, manufacturers, payment providers, technology providers and delivery partners.

Their involvement does not automatically transfer or remove responsibilities that applicable Nepal law places directly on Fabdale.

To the extent legally permitted, Fabdale will not be responsible for losses caused solely by a customer's fraudulent conduct, intentional product misuse, materially inaccurate information supplied by the customer, or another circumstance for which applicable law does not impose liability on Fabdale.

Delivery or fulfilment may occasionally be affected by genuine events beyond reasonable control, including natural disasters, severe transport disruption, government restrictions or similar extraordinary events.

Fabdale will make reasonable efforts to communicate material disruptions and provide a lawful solution.

Nothing in this section excludes liability or consumer rights where such exclusion is prohibited by Nepal law.

25. Complaints, Governing Law & Changes to These Terms

Customers may submit complaints concerning products, orders, payments, delivery, returns, refunds, privacy or other Fabdale services through the available Customer Support or Grievance Centre.

Fabdale will register and handle grievances according to applicable Nepal law and its Grievance Redressal procedure.

These Terms and transactions made through Fabdale.com are governed by the applicable laws of Nepal.

If any provision of these Terms conflicts with a mandatory provision of Nepal law, the mandatory legal provision will prevail.

Fabdale may update these Terms when its services, operations or legal requirements change. The current version will display its Last Updated date and version number.

The version applicable when an order was placed will ordinarily remain relevant to that transaction, subject to mandatory legal requirements.

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
